Acceptable Use Policy

Purpose and Scope

This Acceptable Use Policy ("AUP") governs the use of all internet services provided by Metanet Technologies Limited ("Metanet"). This AUP applies to all customers, users, and any person who accesses or uses the Services through the Customer's connection, including employees, contractors, guests, and family members.

This AUP supplements and forms part of the Terms of Service. In the event of a conflict between this AUP and the Terms of Service, the more restrictive provision shall apply.

Metanet reserves the right to update this AUP at any time. Material changes will be communicated at least 30 days before taking effect.

Customer Responsibility

The Customer is responsible for all activity that occurs through their internet connection, regardless of whether the Customer directly performed the activity. This includes activity by:

  • Family members, housemates, and guests
  • Employees, contractors, and visitors (for business accounts)
  • Unauthorised users who gain access to the Customer's network due to inadequate security

The Customer is strongly encouraged to secure their network with strong passwords, enable router firewalls, and keep all connected devices updated.

Prohibited Activities — General

The following activities are strictly prohibited and constitute a material breach of the Agreement:

  • Illegal activity: Any activity that violates the laws of the Republic of Kenya, including but not limited to the Computer Misuse and Cybercrimes Act 2018, the Kenya Information and Communications Act, the Prevention of Terrorism Act, and the Sexual Offences Act
  • Child exploitation: Any creation, distribution, possession, or access of child sexual abuse material. Such activity will be reported immediately to law enforcement without prior notice to the Customer
  • Terrorism and extremism: Using the Services to promote, facilitate, or support terrorism or violent extremism
  • Fraud: Using the Services for identity theft, phishing, financial fraud, or any form of deception

Prohibited Activities — Network

  • Denial of service: Launching or participating in denial of service (DoS/DDoS) attacks against any target
  • Network scanning: Unauthorised port scanning, vulnerability scanning, or network probing of systems not owned by the Customer
  • Packet manipulation: IP spoofing, packet forging, or any form of packet manipulation designed to disguise the origin of traffic
  • Interception: Intercepting, monitoring, or capturing network traffic not intended for the Customer
  • Exploitation: Attempting to exploit vulnerabilities in any system, service, or network
  • Botnets: Operating, controlling, or participating in a botnet or any form of distributed malicious network

Prohibited Activities — Content

  • Spam: Sending unsolicited bulk email, SMS, or messages of any kind
  • Malware: Hosting, distributing, or facilitating the spread of viruses, worms, trojans, ransomware, spyware, or any other malicious software
  • Copyright infringement: Distributing copyrighted material without proper authorisation from the rights holder
  • Defamation: Publishing false statements that damage the reputation of individuals or organisations
  • Harassment: Using the Services to stalk, threaten, intimidate, or harass any person
  • Impersonation: Impersonating any person, organisation, or Metanet employee

Prohibited Activities — Commercial

  • Resale: Reselling, redistributing, or sharing the Services with third parties without prior written consent from Metanet
  • Hosting commercial services: Operating commercial hosting, data centre, or co-location services on residential connections
  • Open proxies and relays: Operating open proxy servers, open mail relays, or open DNS resolvers
  • Cryptocurrency mining: Operating cryptocurrency mining operations that degrade network performance for other customers

Network Management

To ensure quality service for all customers, Metanet implements reasonable network management practices:

  • We monitor aggregate traffic patterns for capacity planning and anomaly detection. We do NOT inspect the content of individual traffic
  • We may implement traffic management during periods of extreme congestion to ensure fair distribution of bandwidth
  • We block traffic from known malicious sources (botnet command and control servers, known malware distribution points)
  • We do NOT throttle, shape, or deprioritise traffic based on application, protocol, or content type
  • We treat all lawful internet traffic equally regardless of source, destination, or application (net neutrality)

Fair Use and Unlimited Data

All Metanet plans include genuinely unlimited data with no fair-use caps, no throttling, and no speed reduction based on usage volume.

However, if a single connection is used in a manner that materially degrades service for other customers on the same network segment (e.g., operating a commercial server farm or data centre on a residential connection), Metanet reserves the right to contact the Customer to discuss an appropriate business-grade solution. We will not restrict service without first engaging with the Customer.

Security Responsibilities

The Customer is responsible for maintaining the security of their network and all devices connected to it:

  • Change default router passwords immediately after installation
  • Use WPA3 or WPA2 encryption for Wi-Fi networks
  • Keep all operating systems, applications, and firmware updated
  • Install and maintain reputable antivirus and anti-malware software
  • Do not connect compromised or infected devices to the network
  • Implement appropriate access controls for business networks

Metanet is not responsible for security incidents arising from the Customer's failure to adequately secure their network or devices.

Reporting Violations

If you become aware of any violation of this AUP, whether by a Metanet customer or any other party using our network, please report it to:

All reports are investigated. Reports may be made anonymously. Metanet will not retaliate against any person who makes a good faith report of a violation.

Enforcement and Consequences

Violations of this AUP may result in one or more of the following actions, at Metanet's sole discretion:

  • Warning: Written notice to cease the violating activity
  • Temporary suspension: Suspension of all or part of the Services pending investigation
  • Speed restriction: Temporary reduction of bandwidth during investigation
  • Permanent termination: Termination of the Services without refund
  • Legal action: Referral to law enforcement and/or civil legal proceedings
  • Cooperation with authorities: Disclosure of Customer information to law enforcement as required by law

Metanet will make reasonable efforts to contact the Customer before taking enforcement action, except where:

  • Immediate action is necessary to protect the network or other customers
  • Required by law or court order
  • The violation involves illegal activity, child exploitation, or terrorism
  • Contacting the Customer would compromise an ongoing investigation

The Customer shall not be entitled to any refund or compensation for service suspension or termination resulting from AUP violations.

Cooperation with Law Enforcement

Metanet will cooperate with law enforcement agencies and regulatory authorities as required by Kenyan law. This cooperation may include:

  • Providing Customer information in response to valid legal process (court orders, warrants, subpoenas)
  • Preserving data as required by law
  • Reporting illegal activity, particularly child exploitation material, to the relevant authorities
  • Providing network logs and technical assistance to investigations

Metanet will not voluntarily disclose Customer information to law enforcement without legal process, except where there is an imminent threat to life or safety.
